Terms, Conditions & Privacy
These Policies, Guidelines, and Terms govern your use of the hosting and related services ("Service") provided by HostExpress LLC (we, us, our). These apply to all clients and domains, including reseller clients and domains residing on our servers. By creating an account, using the Service, or paying for the Service, you agree to these Terms. If you do not agree, you must not use the Service.
1. Eligibility and Age Requirement
You must be 18 years or older to use the Service. By using the Service, you represent and warrant that you meet this requirement.
2. Account Information
Customers must maintain valid and accurate contact information at all times. Resellers must also maintain valid end-user contact information for services being resold.
3. Acceptable Use
All services provided by HostExpress LLC may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of United States Federal, State, or Local law, or containing unauthorized private, medical, or financial information, is prohibited.
Prohibited content includes, but is not limited to:
Unauthorized copyrighted material
Threatening, abusive, hateful, or obscene content
Material protected by trade secret law
Improperly stored credit card or financial information
Malware, viruses, or harmful code
Hacking tools, pirated software, or warez
Sites promoting hate, violence, harassment, or illegal activity
Sites promoting unsolicited email (spam)
Pornographic or sexually explicit content of any kind
We are the sole arbiter of what constitutes inappropriate or harmful use of the Service. We reserve the right to suspend or terminate accounts that violate these guidelines.
4. High-Resource Activities
Some sites require additional system resources, including forums, archives, galleries, IRC, bots, download sites, or any site frequently targeted by automated traffic.
If your site consumes excessive system resources, such usage may be limited or you may be contacted to resolve the issue. HostExpress LLC will be the sole arbiter of what constitutes excessive usage.
5. Disk Usage, Bandwidth, and Statistics
Hosting services include predetermined resource limits. Resource usage can be viewed in our control panel. Additional fees apply for storage and bandwidth overuse.
Items listed as Unlimited, including domains, email accounts, or databases, are not restricted by a numerical count, but may require the purchase of additional server resources if system limits are reached.
Log files are rotated daily and stored for approximately two days. Web statistics are offered as is. If statistics are not generated before log rotation occurs, those statistics will not be available.
6. Email Usage and Retention
Email stored in your Inbox and Sent folders are automatically retailed for 180 days, emails in other standard system folders (Trash, Spam etc) are retained on the server for 30 days. If you need to keep any message longer, they should be moved to a custom folder or downloaded and saved on your device. This service is not intended to be used as a long-term email archive.
We utilize RBL services such as Spamcop.net and Barracuda. HostExpress LLC reserves the right to block, bounce, discard, or filter any email sent to or from our servers including forwarded emails and rules to protect system integrity.
7. Spam / Commercial Email
Spamming or sending unsolicited email from any HostExpress LLC server, or referencing a domain hosted on our network when sending unsolicited email, is strictly prohibited.
Mailing list requirements:
All users must join via double opt-in
Verification logs must be retained
Logs must be provided upon request
Failure to provide logs may result in suspension of mailing privileges
8. Offering Free Services
Clients may not offer free email, free hosting, or free homepages on shared hosting plans. Such services may be permitted on dedicated servers.
9. Automated Account Creation
Automated hosting or email account creation scripts are not permitted.
10. Security and Server Abuse
Any attempt to undermine, compromise, or cause harm to a server or customer of HostExpress LLC is strictly prohibited.
11. Customer Security Responsibilities
Customers are solely responsible for maintaining the security of their accounts, sites, and applications. This includes:
Using strong, unique passwords
Keeping CMS platforms (WordPress, Joomla, etc.) updated
Updating plugins, themes, and components
Removing abandoned or insecure software
HostExpress LLC is not responsible for breaches or data loss caused by outdated or insecure customer software.
12. Data Protection, Privacy, and Security Incidents
We take reasonable measures to protect personal information stored on our systems. Customers are responsible for ensuring they have a lawful basis for storing or processing personal data using our Service.
Host Express Limited processes only the information necessary to operate and maintain it's services. Information such as account details, login information, and email data is handled as required to provide the Service, protect system security, and comply with applicable laws. Host Express Limited does not sell customer information. Use of the Service constitutes consent to this handling of information as described.
If we become aware of a security incident involving your hosted data, we will investigate and, where required by applicable law, notify affected customers without undue delay.
13. Backup Policy
HostExpress LLC maintains rolling system backups for disaster recovery for approximately 7-10 days. These backups are not intended for individual file restoration and recovery is not guaranteed.
Customers must keep their own off-server backups of websites, databases, and email data.
14. Service Modifications and Pricing
We reserve the right to modify features, services, or pricing at any time. Pricing changes apply to future billing periods. Continued use of the Service constitutes acceptance of updated pricing.
15. Billing
All credit cards are billed automatically for hosting fees and overages. It is the customers responsibility to ensure sufficient credit is available. Failed charges may result in service interruption.
16. Refunds and Cancellations
We offer a 30-day money-back guarantee for new shared hosting accounts. Refunds are not available after 30 days.
Cancellations must be received at least 15 days prior to the billing due date and are not complete until confirmed by email.
17. Refusal or Termination of Service
HostExpress LLC reserves the right to refuse, cancel, or suspend service at our sole discretion. Accounts may be removed without notice in cases of severe abuse or risk.
18. Limitation of Liability
HostExpress LLC shall not be responsible for any damages, including incidental or consequential damages, arising from downtime, server issues, hacking, data loss, or customer negligence. We are not liable for lost profits or losses resulting from service interruption.
19. Disclaimer of Warranties
The Service is provided on an AS IS and AS AVAILABLE basis without warranties of any kind.
20. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, utility outages, DDoS attacks, war, labor disputes, or major Internet disruptions.
21. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania. All disputes must be resolved exclusively in Pennsylvania state or federal courts.
22. Changes to Terms
We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
